Recommendation, Proposal, and Plan for HOA Dissolution

The Board of Directors recommends dissolution of the Association for the following reasons:
No Remaining Responsibilities
The lake is owned and maintained by the lake owners.
Roads are maintained by the Public Improvement District (PID).
The Association owns no common property.
No Enforcement Authority
The Association may only recommend compliance with Larimer County laws.
Enforcement authority rests solely with Larimer County.
No Benefit to Continued Existence
Mandatory dues no longer provide a corresponding benefit to lot owners.
The Association’s existence creates an administrative burden without a functional purpose.
Legal Compliance
Dissolution complies with the Declaration and the Colorado Revised Nonprofit Corporation Act.
For these reasons, the Board unanimously recommends termination of the Covenants and dissolution of the Association.
